1. In this Service Contract (“Contract”), South Shore Yacht Club (the “Club”) provides the Member (which includes the Shared Member, if applicable) whose name appears below with winter storage for a boat on the Club grounds inside the main fence. The storage is further defined below.
2. This Contract is appended to and incorporated as part of that certain Member Agreement bearing the Member’s name for 2026/27 and signed and on file with the Club.
3. Winter Storage is available to Active and Active Life members who are in good standing. This Contract entitles such a Member to store the boat identified below (the “Boat”) on the Club Grounds for the 2026 - 2027 winter season (“Winter Storage”), subject to terms and conditions further set out below. As noted in the Member Agreement, this Contract is good only for the season specified, is not automatically renewable and is renewable only at the sole discretion of the Club.
4. If the boat is a sailboat stored “mast down,” the Club will also provide a spot on the Club spar rack for storage of the boat’s mast. A mast stored on the rack must be disassembled – including removal of spreaders – and lashed for storage by the Member. Spreaders can be lashed alongside the mast.
5. The fee for the Winter Storage is developed on a square-foot basis. The fee for the Boat for the 2026 - 2027 storage season is $2.85 per square foot. A deposit of $200 is due by June 12th, 2026, and will be billed through normal Club accounts. If the deposit is not timely paid, this Contract will be void and the space may be offered to another member.
6. The full storage fee remainder will be billed in two equal installments in June and July, with due dates of July 25th and Aug 25th . If the full fee is not timely paid, this Contract will be void and the space may be offered to another member.
7. In addition to any other penalties or fees described elsewhere, if the Member cancels this Service Contract or Agreement before August 1 of the anticipated fall haul-out date, the Club will charge a 15% cancellation fee while refunding the remainder of the paid fee to the Member. After August 1 of the anticipated fall haul-out year, the Member may not cancel the contract, and the Club will retain 100% of the paid amount.
8. A copy of the Club’s “Winter Storage Rules” will be provided to each member interested in Winter Storage. Failure to abide by the Winter Storage Rules may result in fines, cancellation of the Contract (with or without a refund), a decision not to renew the Contract in subsequent years, or a decision by the Club, in its sole discretion, to take necessary remedial action and to bill the Member, impose a lien on the Boat, or both.
9. Club Rules, Procedures and Policies apply, as do any conditions that are or may be enacted by the Club.
10. Fees and storage charges are subject to modification, based on previously established boat length and beam measurements, confirmation of measurements during haul out, or other factors described below.
11. Winter Storage includes a fall haul-out and mast unstepping if indicated and a spring launch and mast stepping if indicated. The Member will be notified of times in the fall and spring during which boats may be launched or hauled. Haul-out normally starts after October 1 and launching normally starts around May 1. The dates are heavily weather dependent. Appointments for haul-out or launching must be made by the Member through the Club Office or website at least 48 hours in advance of the requested time. A Member whose boat will be stored in critical access aisles will be notified ahead of the Member’s haul-out/launch dates by the Club launch crew.
12. Masts will not be stepped on the first two weekend days on the spring launch calendar due to the high volume of boats that need to be launched to clear critical access aisles to the crane, the unpredictability of early spring weather and safety of the launch crew.
13. Failure to be ready to launch at the Member’s appointed time may subject the Member to a $100.00 penalty unless the appointment has been cancelled or revised 24 hours in advance. Launch times for boats in critical launch access aisles cannot be revised or cancelled by the Member.
14. Failure to launch the Member’s boat and/or spar from the Club grounds by the final day of the launch schedule will expose the Member to a penalty of up to $100.00 per day until the boat is removed from Club grounds.
15. Haul-out or launch time is limited to one hour per boat and a half hour for a spar. If unusual circumstances require more time, arrangements must be made with the Derrick Operator, or a penalty of $35.00 will be assessed for the first half hour over the allotted time, and $25.00 for each additional hour.
16. Skids, trailers and structures for boats to be stored on Club grounds may not be placed on Club grounds sooner than 48 hours before haul-out and must be removed from Club property no later than 48 hours after launching. The Club reserves the right to assess a penalty of $50.00 per day for violations and may remove skids, trailers and structures from the Club grounds at the expense of the Member. The Club shall have no responsibility for boats, skids, trailers and structures removed from the Club grounds.
17. The Club provides launch and haul-out services using the Club main hoist and its slings. Any other equipment, including but not limited to single-point lifting equipment, must be provided by the Member and is done so at the Member’s sole risk and responsibility. The Club will not be responsible in any fashion for such Member-provided equipment.
18. The Member is required to file proof of public liability insurance coverage in the amount of at least $300,000, listing or effectively naming the Club as an other-named-insured, such coverage to remain in effect through the term of the Winter Storage, before this Contract will be valid and before the related Agreement will be signed by the Club.
19. Release of Liability: Member recognizes that there are risks of injury to persons and property which may occur during the period that this Contract is in existence and which might occur in the absence of any intentional or reckless conduct on behalf of the Club or any of its employees. In addition, the Member recognizes that despite the Club's best efforts, Members' property might be subject to theft, vandalism, fire and naturally occurring events over which the Club has no control.
20. The Club is not and will not be responsible for any injuries (including death), or property damage resulting, caused by, or growing out of the use of the Club facilities. The Member releases and discharges the Club and its officers, directors and employees from any and all liability for such loss, injury, death or damage to persons or property sustained incidental to the services provided under this Contract. The use of Club property is entirely voluntary and at the risk of the Member.
21. The Club provides launch and haul-out services using the Club crane and slings. Any other equipment, including but not limited to single-point lifting equipment, must be provided by the owner and is done so at the owner's sole risk and responsibility. The Club will not be responsible in any fashion for such owner-provided equipment.
